Policy purpose            

The purpose of this policy is to explain how we collect personal information, and use, store and share personal information we collect, in alignment with our values. Te Mana – Shared Pride, Te Ihi – Shared Prosperity and Te Wehi – Shared Opportunity

 

Our privacy commitments

1. We only collect personal information that is necessary

We only collect personal information that is necessary to the function and activities of Trust Tairāwhiti. If your personal information is not required for a particular purpose or activity, we will not collect it.

2. We collect information directly from the person

Where possible, we collect information directly from the person the information is about and in ways that are lawful, fair and not intrusive. We take particular care about how we collect information from and about children and young people. However, in certain circumstances, we may collect from other sources, such as where:

a. You have given permission for us to collect the information from someone else.
b. Collecting the information from someone other than you would not prejudice your interests.
c. Collecting information directly from you would undermine the purpose of the collection.
d. It is necessary for the enforcement of the law or for the conduct of proceedings.
e. We are receiving the information from publicly available sources.

4. How we storesyour personal information

Trust Tairāwhiti stores your personal information in a controlled, secure environment, protected from unauthorised access, use or disclosure. Our security safeguards include:

a. Staff education – we train and remind our staff of their obligations with regard to your personal  information
b. Destruction of data when no longer required – where practical, we keep information only for as long as required (for example, to meet legal requirements or our internal needs)

5. We understand your personal information is important

We understand that your personal information is important to you and appreciate that you choose to provide it to us. Should you ever want access to your information, please ask. We will usually grant requests for access, but sometimes we can decline a request. We might decline a request where, for example, giving the information would:

a. Endanger a person’s safety.
b. Prevent detection and investigation of criminal offences.
c. Involve an unwarranted breach of someone else’s privacy.

Should you believe we have incorrect information about you, please let us know.  If we think you are right, we will update the information and share with you the corrections we have made. If we disagree, we will not correct the information, but we will add to it your views about what the correct information is.

6. Before we use or disclose personal information

Before we use or disclose personal information, we take reasonable steps to ensure the information is accurate, up to date, complete, relevant, and not misleading. This helps to ensure that all people, whānau and communities of Tairāwhiti have unhindered access to support and opportunities that enhance their wellbeing.

7. We will not store your personal information any longer than is necessary.

8. Using your personal information

We will only use your personal information for the purpose for which it was collected, unless we reasonably believe that:

a. The purpose for which we propose to use your personal information is directly related to the purpose for which it was collected; or
b. The information will be used in a form that does not identify you; or
c. The information is from a publicly available publication and in the circumstances, it is not unfair or unreasonable for us to use it;
d. Its use is necessary to avoid endangering someone’s health or safety; or
e. Its use is necessary to uphold or enforce the law or for court proceedings; or
f. Other circumstances set out in the Privacy Act 2020 apply.

9. Disclosing your personal information

We will only disclose your personal information in the permitted limited and clearly defined circumstances set out in the Privacy Act. For example, we can disclose information if we reasonably believe that:

a. Disclosure is one of the purposes for which we collect the information; or
b. You have authorised the disclosure; or
c. The information will be used in a form that does not identify you; or
d. Disclosure is necessary to avoid endangering someone’s health or safety; or
e. Disclosure is necessary to uphold or enforce the law or for court proceedings; or
f. Other circumstances set out in the Privacy Act 2020 apply. 

10. Keeping your information onshore

As the regional development trust for Te Tairāwhiti our focus is on our people and communities. We do not expect to send personal information to overseas parties and look where possible to keep your information onshore.  We will not send your information overseas unless you give permission, or where we are permitted to do so for the purposes of upholding or enforcing the law or for health and safety reasons.

11. Unique identifier

We will only use a unique identifier for you where it is necessary, for example, to make it simpler to keep track of a funding application.

12. In the event of a privacy breach

In the event of a privacy breach where there has been unauthorised or accidental access to personal information, or disclosure, alteration, loss or destruction of personal information, we will take reasonable steps to immediately contain the breach. If the privacy breach has caused serious harm to someone (or is likely to do so) we will - as soon as possible after we become aware of the privacy breach:

a. notify the Office of the Privacy Commissioner; and
b. notify people affected by the privacy breach.
